Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://vehiclefilter.be website (hereinafter, the "vehiclesurety"), operated by Secure Online Managements S.L. (hereinafter, "us", "our" or "we"), a company incorporated under Spanish law with registered office at C/ Creueta, 20, 08870, Barcelona, Spain, holder of Tax Identification Number B.01.79.48.66.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not access the Service.

By using this Service, you undertake not to reproduce or extract any vehicle data from our website or mobile applications without our written consent. You also undertake not to use any “screen scraping” software or any other automated system to extract or reproduce vehicle data displayed on our website or mobile applications.

Purchases

It is recommended that you become familiar with your rights under Spanish regulations, especially Law 7/1998, of 13 April, on General Contracting Conditions; Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users; and other applicable consumer protection legislation.

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to provide certain information relevant to your Purchase, including, but not limited to, your credit card number, its expiry date, your billing address and your shipping address.

You represent and warrant that: (i) you have the legal right to use any credit card or other payment method in connection with a Purchase; and (ii) the information you provide us is true, correct and complete. You expressly agree that vehiclesurety shall not be liable for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide this information to third parties for the purpose of facilitating the completion of Purchases.

vehiclesurety has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that vehiclesurety shall not be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever and without limitation, if you breach these Terms.

Upon termination, your right to use the Service will cease immediately.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnities and limitations of liability.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will endeavour to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

Enquiry Terms and Conditions ("Enquiry Terms and Conditions")

These are the terms and conditions (the "Conditions") under which vehiclesurety ("us" or "our") provides the vehicle enquiry service, available to customers ("you") who make an Enquiry.

Definitions

• We use the following key expressions in these Terms:
• "Contract" refers to the contract between you and us for the supply of the Information, subject to these Terms.
• "Information" refers to the information we provide to you about a vehicle registered in our database in response to your Enquiry.
• "Application" refers to any service, mobile application, or website that accesses the vehicle history information provided by vehiclesurety.
• "Enquiry Request" or "Enquiry" is the request you submit through the Application to obtain information about a vehicle.
• "you"/"your" refers to you, the customer, who submits an Enquiry and receives the Information (in all cases subject to these Terms).

Formation of the Contract

• 2.1 By submitting a request through the Application, you are making a legal offer to enter into a Contract with us, which we may accept or decline at our discretion. If we decline your offer, we will not process your payment or we will refund any payment already made.
• 2.2 The Contract will only come into existence between you and us when we provide you with the Information in response to your Enquiry.
• 2.3 We consider these Terms to represent the entire agreement between you and us.
• 2.4 These Terms only apply to our contracts with consumers. You state that you are acting as a consumer and not as a vehicle trader.
• 2.5 The Information obtained through the Application is for your personal use and does not replace a physical inspection of the vehicle or professional advice. We reserve the right to deny the Service if we detect any fraudulent use.
• 2.6 By submitting a request through the Application, you assume responsibility for the data provided and release vehiclesurety from claims related to errors in the information you have entered.

Enquiry

• 3.1 By submitting your request through the Application, you are responsible for completing the required data accurately.
• 3.2 We will provide you with the Information once we have received your payment, displaying the results on screen.

Use of the Information

• 4.1 The Information we provide is for your personal use.
• 4.2 You must not sell, supply or disclose the Information to third parties. However, you may provide a printed copy of the history report to a buyer or seller in the context of a legitimate purchase/sale.
• 4.3 If you know or suspect that the Information we provide is incorrect or incomplete, please inform us immediately.

Charges

• 5.1 You are responsible for paying the charges shown in the Application for the requested service.
• 5.2 You must verify that you have correctly selected the options of our Service before clicking "Buy now" (or equivalent).
• 5.3 We will not provide the Information until the payment has been successfully processed.
• 5.4 Multi-check vouchers, when available, have a specified validity period from the date of purchase. Once expired, they cannot be used or refunded.

Right of Cancellation

• 6.1 Given the nature of the Service (immediate delivery of information), we do not accept cancellations once payment has been completed. By accepting these Terms and purchasing our Service, you acknowledge that you waive your right of withdrawal for digital content that is delivered immediately.
• 6.2 If you have purchased a Multi-check voucher and it has not been used, you have 14 days from the date of purchase to request a refund. If the voucher is unused, the amount will be refunded.
• 6.3 Expired Multi-check vouchers are non-refundable.

Use of Your Personal Data

• 7.1 We collect and store vehicle data from various sources to protect users and vehicle owners.
• 7.2 By using our Service, you agree that we may disclose the information we deem necessary to the competent authorities for the prevention or detection of crimes, always in accordance with applicable data protection regulations.
• 7.3 You expressly agree that we may provide such information to police or judicial bodies, if required.

Limitation of Liability

• 8.1 The Information we provide comes from third parties. We do not warrant that it is entirely accurate or error-free. Subject to applicable legal limits, we shall not be liable for any damages or losses caused by inaccuracies or omissions in the Information.
• 8.2 We do not limit or exclude our liability in cases where it is prohibited by law to do so, including cases of gross negligence or wilful misconduct.
• 8.3 Except as expressly provided in the Contract, all other conditions, terms and warranties are excluded to the fullest extent permitted by law.
• 8.4 Each provision of this section 8 is to be interpreted separately, and the remainder shall remain valid in the event that any provision is declared void or unenforceable.
